OVERVIEW

This website is operated by SOA BEM. Throughout the site, the terms "we", "us", and "our" refer to SOA BEM. SOA BEM offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

SECTION 1 – CONCLUSION OF CONTRACT AND ACCOUNT

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your country of residence. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Place binding order" (Zahlungspflichtig bestellen) button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is sent together with the acceptance of the order immediately after sending via an automated email. The purchase contract is concluded with this email confirmation.

SECTION 2 – PRODUCTS AND CUSTOM-MADE ITEMS

We make every effort to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your monitor's display of any color will be accurate. Special note on custom-made items: For products manufactured according to customer specifications (e.g., custom audio devices, individually assembled cables), there is no right of withdrawal pursuant to Section 312g (2) No. 1 BGB (German Civil Code). Production begins after receipt of payment.

SECTION 3 – PRICES AND PAYMENT TERMS

The prices stated on the product pages are final prices. They include the statutory value-added tax (if applicable, depending on the customer's delivery country) and other price components. Shipping costs are calculated during the checkout process and clearly displayed before the order is submitted. For deliveries to countries outside the European Union, additional costs may arise in individual cases for which we are not responsible and which are to be borne by you (e.g., customs duties or import sales tax). Payment is made via the payment methods offered during checkout.

SECTION 4 – SHIPPING AND TRANSFER OF RISK

Delivery takes place within the period specified for the respective product. For custom-made items, the period begins after all technical details have been clarified and payment has been received. In transactions with consumers, the risk of accidental loss and accidental deterioration of the sold goods only passes to you upon delivery of the goods.

SECTION 5 – WARRANTY (LIABILITY FOR DEFECTS)

Statutory warranty rights apply. In the event of a defect in the goods, you have the statutory claims for supplementary performance (remedy of defects/new delivery) and—if the legal requirements are met—further claims for reduction of the price or withdrawal from the contract, as well as damages.

SECTION 6 – LIMITATION OF LIABILITY

We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence. In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfillment is essential for the proper execution of the contract in the first place), our liability is limited to the contract-typical, foreseeable damage. In all other respects, liability is excluded.

SECTION 7 – RETENTION OF TITLE

The goods remain our property until full payment has been received.

SECTION 8 – ONLINE DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

SECTION 9 – GOVERNING LAW

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another country, the mandatory legal provisions of that country remain unaffected.
